BitMobile Rewards Program Terms and Conditions

Welcome to the BitMobile Rewards Program!

This document outlines the terms and conditions for participating in the program, which is offered by BitMobile (Pty) Ltd. (the “Company”) in South Africa. By registering your Phenix X phone and participating in the program, you agree to these terms and conditions.

1. Eligibility and Registration

1.1. This program is open to all residents of South Africa who are 18 years or older and who have purchased a new Phenix X phone. 1.2. To participate in the program, you must register your Phenix X phone using the pre-loaded authentication app on the device. 1.3. Registration is considered complete 30 days after successful completion of the registration process.

2. Rewards

2.1. The program offers the possibility of receiving a reward payout to your digital wallet at the end of each month (on the last day of the month). 2.2. The Company reserves the right to determine the amount and frequency of payouts at its sole discretion. 2.3.  Participation in the program does not guarantee a payout every month. 2.4. You are not required to take any additional action to be eligible for a reward each month after successful registration.

3. Phone Usage and Reward Eligibility

3.1. To be eligible for potential rewards, your Phenix X phone must be actively used for communication purposes (calls, texts, data usage)  throughout the month. 3.2. The Company reserves the right to determine what constitutes “active use”  for reward eligibility purposes, at its sole discretion. 3.3.  The program is limited to one reward payout per registered Phenix X phone per month.

4. Disclaimers and Limitations

4.1. The Company is not responsible for any use of the rewards by the user. 4.2. You are solely responsible for how you utilize the funds received as rewards. 4.3. The Company does not offer any warranty or guarantee regarding the amount or frequency of rewards. 4.4. The Company reserves the right to modify, suspend, or terminate the program at any time without prior notice.

5. Tax Implications

5.1. The Company will track all reward payouts. 5.2. In accordance with South African Consumer Protection Act (CPA) regulations, the Company will provide relevant information to the South African Revenue Service (SARS) if the total value of rewards paid to your wallet in a tax year exceeds the threshold requiring tax reporting. 5.3. You are responsible for any taxes associated with the rewards you receive.

6. Phone Lifespan and Program Duration

6.1. The program rewards will be available for the functional life of your Phenix X phone, up to a maximum of 3 years from the date of registration. 6.2. The Company is not responsible for any hardware or software malfunctions that may prevent you from receiving rewards after the 3-year period.

7. Governing Law

7.1. These terms and conditions shall be governed by and construed in accordance with the laws of South Africa.
